After deliberation, the General Assembly concluded that traditional sources of revenue historically relied upon by the State for infrastructure funding would be insufficient to properly address the severity of the issue. In 2016, the Rhode Island General Assembly passed the Rhode Island Bridge Replacement, Reconstruction, and Maintenance Fund Act of 2016 (the “RhodeWorks” Act) in response to the information that approximately 23% of the State’s bridges are considered structurally deficient. The case is tangled up in evidentiary disputes, but language from the courts so far indicates that the matter will be allowed to proceed to trial on the merits of the constitutional challenge. The state’s decision to toll only commercial trucks has come under fire from a host of freight organizations who have contested the constitutionality of such a discriminatory scheme. Litigation pending in the First Circuit challenges the State of Rhode Island’s decision to implement truck-only tolls to pay for its drastically underperforming transportation infrastructure. The nation will get at least one federal court’s answer to that question sometime soon.
